1. Applicability
These conditions apply to all agreements entered into by vof Hengelsport 2000 for the purchase and delivery of products via the Internet. If the customer refers to their own general terms and conditions, those conditions do not apply.
2. Prices and Shipping Costs
All price quotes are entirely without obligation and valid while supplies last. All prices used by vof Hengelsport 2000 are in Euros and include VAT, excluding shipping costs. We ship for free within the Netherlands for orders over 100 euros, with the exception of promotional items and special sizes such as longer packages. Prices can be adjusted by vof Hengelsport 2000 at any time, provided that if the price is adjusted after entering into the agreement, the customer is free to dissolve the agreement without being able to claim any compensation.
- Packages longer than 80 cm can only be shipped within the Netherlands due to extra surcharges by the carrier.
- Packages for the Wadden Islands are only sent with a surcharge of € 5.50.
3. Payment
Payment of the amount owed to vof Hengelsport 2000 can be made in one of the following ways: Bank transfer in advance: the customer transfers the amount to account number NL51INGB0008643645 in the name of vof Hengelsport 2000 (IBAN: NL51INGB0008643645 and BIC: INGBNL2A) mentioning the order number. Or via Paypal or Bancontact. As soon as the payment is credited to our account, the goods will be shipped to the customer within 3 working days. If the payment is not credited to this account within 5 working days after ordering, the order will be automatically canceled.
4. Delivery
The ordered goods are shipped within three working days after receipt of the customer's payment. If ordered items are out of stock and the customer has already paid but short-term delivery is not possible, the paid funds will be returned. This dissolves the agreement. Stated delivery times are target times only, starting as soon as all necessary details for the execution of the agreement are in our possession, and are therefore not binding. Exceeding them - for example due to late delivery by the manufacturer or postal services - does not entitle the customer to claim any rights against us. Vof Hengelsport 2000 is therefore not liable for any damage resulting from exceeding the delivery period.
5. Risk and Quality
The risk concerning the products to be delivered transfers to the customer as soon as they are presented at the destination. If the customer fails to take delivery of the products, the resulting damage and costs are at their expense. Any returns to vof Hengelsport 2000 are at the customer's expense, must be sent carriage paid, and include a written statement of reasons. Vof Hengelsport 2000 commits to the customer to deliver goods manufactured from sound materials that are substantially similar to the images on the website. However, the customer must take into account minor size and color differences of the depicted products. Such deviations do not give the customer the right to refuse receipt or payment of the delivered goods, to demand adjustment of their obligations, or any compensation from vof Hengelsport 2000.
6. Returns
The goods can be returned within 14 days without giving any reason, stating name, address, and bank details. The items must not be damaged or used. The shipping costs of the return are borne by the sender/customer. Within 14 days after the return, the customer will receive the money back in their bank account.
7. Privacy and Data Protection
The data entered by the customer is registered in accordance with the Personal Data Protection Act (WBP) and is used exclusively to provide the requested information or to deliver the ordered items to the correct destination. The data will not be provided to third parties. Your address details are only stored for warranty purposes and are not used or passed on to third parties. By entering into an order via the webshop, you give permission to use your email address for our newsletter, which will be sent max. 1x per year. If you do not appreciate this, you can indicate this during the order at "add comment".
8. Warranty and Complaints
Vof Hengelsport 2000 guarantees that all delivered items meet the specifications listed on the site. Should the delivered items not meet the specifications or not be in good condition, you must report this to vof Hengelsport 2000 within 14 days by telephone at +31 20 6948271 or via e-mail: hengelsport2000@hotmail.com or hengelsport@ziggo.nl. Customer complaints must be made known to vof Hengelsport 2000 in writing within 14 days of delivery, with a clear description of the complaint. Any claim by the customer against vof Hengelsport 2000 regarding defects in the products delivered by us expires if: the defects have not been reported in accordance with these conditions; the products are no longer in the condition in which they were delivered.
9. Liability and Force Majeure
Vof Hengelsport 2000 is never obliged to pay any compensation to the customer and others, except for intent or gross negligence on the part of vof Hengelsport 2000. In case of force majeure - to be understood as any circumstance beyond our control, of such a nature that compliance with the agreement cannot reasonably be expected of us - the customer cannot hold us liable for compensation.
10. Other Provisions
- Only Dutch law applies to my offers and agreements.
- If paid orders have not been collected after 1 year, the order and the right to a refund of the payment expire.
